Terms of Service

Published October 12, 2026 · Effective for new users October 12, 2026 and existing users December 1, 2026 · Version 2026-10-12

Please read these Terms carefully before using taxsaleproperty.ca. They govern your use of the Service and contain important information about your rights and obligations.

1. Acceptance of Terms

By accessing or using taxsaleproperty.ca (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

taxsaleproperty.ca aggregates publicly available tax sale property listings from Canadian municipal and provincial government sources. The Service provides listing discovery, search, filtering, saved searches, and email alerts. Listing data is sourced from official government publications and is provided for informational purposes only.

3. Accuracy of Information

Official municipal or provincial notices and the responsible sale authority's current instructions control over our summaries. A passed deadline does not by itself prove that a sale completed. Maps, imagery, geocoding, acreage, parcel outlines, assessed values, minimum bids, access indicators, statuses, and other enriched fields are research aids—not surveys, appraisals, title opinions, or guarantees of boundaries, access, condition, buildability, ownership, value, or availability. Always verify the current notice and bidding requirements directly with the responsible authority before acting.

4. Not Legal or Investment Advice

Nothing on this Service constitutes legal, financial, investment, or real estate advice. Tax sale investing involves significant risk. Consult a qualified real estate lawyer and financial advisor before bidding on any property. We are an information aggregator, not a licensed real estate brokerage.

5. Subscription Plans and Billing

Certain features require a paid subscription ("Investor Plan"). Before you submit payment, checkout displays the price in Canadian dollars, taxes, trial duration, renewal price, billing frequency, renewal timing, and cancellation terms. Subscriptions renew automatically through Stripe until cancelled. You may cancel from your account settings; cancellation stops future renewals and access continues through the paid period. Paid monthly and annual subscription fees are final and non-refundable, with no prorated refund for unused time, except where applicable law requires otherwise or we confirm a billing error. A Tax Sale Property subscription is separate from purchases on any other website, including Tax Sales Portal.

6. Free Trial and Card Authentication

Eligible new accounts may receive a 7-day Investor Plan trial. Stripe collects and authenticates your card to activate the trial; the current checkout does not charge a trial verification fee. Your subscription renews automatically at the price and time displayed at checkout unless you cancel beforehand. Prepaid cards are not accepted. Historical CAD $1 verification charges remain credited toward the first eligible paid invoice, or remain on the Stripe customer record for a future eligible invoice if cancellation occurs before conversion. Subscription charges after conversion are governed by the Refund Policy.

7. One-Time Document Purchases

A document purchase is separate from a subscription. The selected file should become available in the purchaser's authenticated account promptly after confirmed payment and no later than 24 hours unless checkout clearly discloses another delivery period. If the file is missing, corrupted, materially incomplete, or not the document described, contact support. If we do not deliver within the promised period, or cannot provide a working and materially correct replacement within two business days after a documented support request, we will refund that document purchase. A correctly supplied document is non-refundable, subject to rights that applicable law does not permit us to exclude. Keep your own copy because lawful retention, source removal, security, or technical constraints may later affect hosted availability.

8. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials. You agree not to share your account with others. You must be at least 18 years old to use the Service.

9. Prohibited Use

You may not: scrape or systematically download listing data; resell or redistribute our content; attempt to access the Service by automated means beyond personal use; or use the Service for any unlawful purpose.

10. Intellectual Property

All content, design, and code on taxsaleproperty.ca is owned by or licensed to us. Underlying factual information about a tax sale may be publicly available; copyright in source documents, notices, and other materials remains with the applicable rights holder. Our enrichment, presentation, and analysis of that information are proprietary.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Tax Sales Portal Inc. and its directors, employees, agents, suppliers, and affiliates are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, investment losses, or missed sale opportunities arising from the Service or a tax sale transaction. For a claim that cannot lawfully be excluded, aggregate liability will not exceed the fees paid through taxsaleproperty.ca during the 12 months before the event giving rise to the claim. Nothing excludes liability that applicable law prohibits us from excluding, including liability for fraud, wilful misconduct, or gross negligence where such exclusion is prohibited.

12. Governing Law

These Terms are governed by the laws of Nova Scotia and the federal laws of Canada applicable there. The courts of Nova Scotia have jurisdiction, but this choice does not limit any mandatory consumer-protection, privacy, language, forum, or class-proceeding right that the law of your province or territory does not permit the parties to waive.

13. Changes to Terms

We may amend these Terms prospectively for legal, security, operational, or service changes. We will identify the new version and effective date. For a material change—including a change to price, recurring billing, refund rights, the nature of the paid service, dispute terms, liability, or personal-information practices—we will send clear written notice to the account email at least 30 days before it takes effect, identify the amended subject, and explain any right to reject the change and cancel without penalty. Where law or the nature of the change requires consent, we will obtain affirmative acceptance rather than treating silence or continued browsing alone as consent.
